Deferred Enforced Departure for Venezuelans

On January 19, 2021, the U.S. Government deferred enforced departure from the United States for Venezuelans. This is wonderful news for Venezuelans present in the United States who do not have status, who need to extend their stay in the country, and/or who have been ordered removed. 

Deferred enforced departure (“DED”) is essentially a suspended deportation. The government is promising that they will not deport Venezuelans for the next 18 months due to the country conditions in their home country. It is similar to TPS in that it does not create legal status for Venezuelans but it does permit them to obtain work authorization and remain in the United States for the next 18 months. 

This action applies to any citizen or national of Venezuela, or any person without nationality who last resided in Venezuela, and who is present in the United States as of January 20, 2021. It will not help Venezuelans who:

  1. Have returned to Venezuela;

  2. Have not resided in the U.S. since January 20, 2021;

  3. Is a security risk;

  4. Have been convicted of a felony or two or more misdemeanors;

  5. Who were physically deported prior to January 20, 2021; or 

  6. Who are subject to extradition.
